Ethics of Asset Protection Planning
Abstract: Many forms of traditional estate planning, including the use of trusts and Family Limited Partnerships, are a form of asset protection planning and raise certain ethical issues for the planner.  Asset protection planning is designed to put the assets beyond the reach of creditors or other claimants.  It is a legitimate form of planning but is surrounded by gray areas where valid planning can lapse into illegitimate areas where creditors are deprived of their rights through arguably fraudulent transfers.  This program will provide you a practical guide to the ethical landmines in asset protection planning, including a review of the applicable rules and regulations, potential ethical, civil and criminal liability, and best practices for avoiding liability, including diligence on clients.  Topics include: Ethics rules and regulations applicable to asset protection planning, Ethical, civil and criminal liabilities, Recent enforcement action by IRS and other government agencies, Best practices for avoiding liability, including diligence on clients before planning and Protecting against existing v. future creditors.

Trustees & Beneficiaries: Managing Tensions and Conflict (Live Replay from July 21,2009)
Abstract: There is a natural tension between trustees and beneficiaries which is exacerbated in a distressed economic environment. Tensions easily arise when investment decisions go awry, discretionary distributions are not made, or when a trust's income beneficiaries are disadvantaged in favor of principal beneficiaries. These and many other natural tensions make trusts difficult to administer and fertile sources of dispute and fiduciary litigation. Led by practitioners with extensive experience representing trustees and beneficiaries, this program will provide you a practical guide to the common sources of beneficiary v. trustee tension, planning and administration to minimize those tensions, and utilizing techniques short of litigation to resolve the disputes once they arise. Topics include: Identifying flashpoints between trustees and beneficiaries; Investment decision conflicts in a distressed market; Tension between income and principal beneficiaries; Planning and administration to minimize tensions and Techniques for resolving disputes short of formal litigation.
